The Management Board of Erbud SA (Issuer) hereby announces that on 19.07.2024 it signed a Significant Contract with a net value of PLN 92 million for construction works: ground works, steel and reinforced concrete structures, water and sewage networks, earthing works, road works, site fencing and noise barriers within the framework of the construction of a complex of facilities for the power output of the Offshore Wind Farm MFW Bałtyk II, subject to the conditions described below:

2. Employer (exact name and registered office): Hitachi Energy Poland Sp. z o.o., 1 Żegańska St., 04-713 Warsaw
3. Contract value (PLN, net): 91,800,000.00
4. Subject of the Contract: Construction works in the scope of: ground works, steel and reinforced concrete structures, water and sewage networks, earthing systems, road works, site fencing and noise barriers, within the framework of the construction of a complex of facilities for power output from the Offshore Wind Farm MFW Bałtyk II - segment of the onshore connection infrastructure
5. Place of Contract performance: Pęplino near Ustka
6. Implementation deadlines:
1. Commencement date - on the date of signature of the Contract
2. Data zakończenia - 30.07.2027
7. Performance bond (value, duration): 10% of the Remuneration in the form of a bank guarantee during the period of performance dates
8. Retention bond (term value): 5% of the Remuneration in the form of a bank guarantee during the 5-year guarantee period
9. Other guarantees (type of guarantee, value, duration): Do not deviate from market standards, basic guarantee of 5 years
10. Penalties: The penalties do not deviate from market conditions for this type of contract. The total amount of contractual penalties shall not exceed 15% of the amount of the Remuneration
11. Comments: Investor of the Project is the MFW BAŁTYK II sp. z o.o.; subcontracted by Branch Office Toruń.
